States Can Deploy Forces to Fight Border ‘Invasion,’ Arizona Attorney General Rules


Sheriffs on the border – as well as both Democrat & Republican Elected Officials – say “crisis” undersells what they’re seeing.

AUSTIN, Texas (Texas Insider Report) — “The on-the-ground violence and lawlessness at Arizona’s Border caused by cartels and gangs is extensive, well-documented, and persistent. It can satisfy the definition of ‘actually invaded’ and ‘invasion’ under the U.S. Constitution,” said Arizona Attorney General Mark Brnovich, issuing an Official Opinion from his office Monday declaring that the surge of illegal immigrants coming across the Arizona-Mexico Border meets the legal definition of an “invasion” under the U.S. Constitution.

In announcing the decision, Brnovich‘s noted his ruling pertains only on the question of the legal situation – adding that it is up to Arizona Gov. Doug Ducey to make the actual determination which would allow the state to “defend itself” under Article I, Section 10 of the founding document.

He said the key sections are:
 
  • Article IV, Section 4, which requires the government to guarantee each state a republican form of government and “protect each of them against invasion,” and
  • Article I, Section 10, which bars states from raising armies or engaging in war “unless actually invaded.”
Mr. Brnovich‘s ruling – which was requested by a member of the Arizona State Assembly – is the most recent salvo in a war of rhetoric concerning how bad the border has gotten under President Biden.

The president and most of his team have refused to label the record surge of people and drugs a “crisis,” much less an invasion.

But sheriffs on the border – as well as both Democrat and Republican Elected Officials – say “crisis” undersells what they’re seeing. Many cities along the U.S.-Mexico Border have long-ago declared "States of Emergency" over having to handle the massive influx of illegal immigrants occurring since Mr. Biden took office.
  Mr. Brnovich‘s opinion elevates the matter to one of "Constitutional proportions."
